1. Supplier
The online store and paid services offered through fuelwholesalers.co.za are provided by the Fuel Wholesalers Association (Pty) Ltd (“FWA”). FWA may be contacted at fwa@fuelwholesalers.co.za, 087 550 0206, Boksburg, Gauteng, South Africa.
2. Scope
These terms apply to transactions completed through the FWA website, including FWA memberships, membership renewals, professional-development products, credentials, member services and any verification or related service expressly offered for purchase on the website.
3. Orders and payment
An order is submitted when the customer completes checkout. FWA may verify the order, customer information, eligibility and payment before accepting the order or activating access. Unless the relevant product page states otherwise, payment is due in full before onboarding, activation or delivery begins.
An electronic order confirmation acknowledges receipt of the order but does not by itself confirm membership eligibility, certification, independent verification, regulatory approval or acceptance of customer-supplied information.
4. Customer accounts and portal access
Customers must provide accurate information and keep account credentials secure. The Customer Account is used for orders and payments. The separate Member Portal is used for approved member access, resources and support. FWA may use transaction and eligibility information to create, match or update portal access.
5. Memberships
FWA membership provides access for the stated membership period and tier. Membership remains subject to eligibility requirements, the FWA Code of Ethics, applicable membership rules and administrative verification. Portal access may be activated after payment and eligibility review.
Membership does not constitute a petroleum licence, regulatory approval, certification or independent verification of a member or supplier. Where recurring billing is not expressly offered at checkout, renewal requires a new payment for the next membership period.
6. Credentials, development and verification services
Professional-development, credential and verification services are limited to the scope stated on the relevant page or order. Customers remain responsible for the accuracy, completeness and authenticity of information and documents supplied. FWA does not act as a petroleum licensing authority and does not guarantee any decision by a regulator or third party.
7. Excluded costs
Unless expressly included on the relevant product page, prices exclude statutory charges, specialist reports, legal opinions, engineering work, environmental work and other third-party costs.
8. Customer responsibilities
The customer must provide requested information within reasonable timeframes, review supplied information, respond to communications and comply with applicable legal and regulatory requirements. Delays caused by missing, inaccurate or late information may affect delivery or activation dates.
9. Cancellation and refunds
Cancellation and refund requests are handled in accordance with applicable law, these terms, the nature of the purchase and the stage of delivery. Requests should be submitted in writing as soon as possible.
Where onboarding, eligibility review, portal activation, credential assessment, verification work or other delivery has begun, any refund assessment may take account of work completed, access provided and non-recoverable costs, to the extent permitted by law. Nothing in these terms limits rights that cannot lawfully be excluded.
10. Electronic communications
The customer agrees that orders, invoices, notices, access instructions and service communications may be delivered electronically using the contact details supplied.
11. Intellectual property
FWA retains ownership of its website content, membership systems, templates, methodologies, branding, publications and member resources. Purchased or member-only materials may be used only for the authorised organisation or individual and may not be resold, redistributed or represented as the customer’s own work without written permission.
12. Liability
FWA will exercise reasonable care in providing its services. To the extent permitted by law, FWA is not responsible for decisions of regulators or third parties, customer-supplied inaccuracies, delays outside FWA’s reasonable control, or indirect or consequential loss.
13. Governing law
These terms are governed by the laws of the Republic of South Africa. Any dispute will be handled through the appropriate South African forum, subject to applicable consumer-protection rights.
